Our core ethos for The Behaviour Club is to give teachers quality professional learning and ongoing support in their classroom practice. This document sets out how we deliver the Membership to you. If you're planning to join The Behaviour Club, please read these Terms in full before you purchase.
Key details
By purchasing the Membership, you accept these Terms ("Terms"). They apply to the services offered by The Unteachables Pty Ltd ("we", "us"). Please read them carefully, as they affect your rights and liabilities and set out how we provide the Membership to you. These Terms are subject to any rights you have under consumer law, including the Australian Consumer Law, that cannot be excluded by contract.
We may update these Terms from time to time. We'll let you know about material changes, and your continued use of the Membership means you accept the updated Terms.
Membership outline
The Behaviour Club is an online membership for teachers who want to build their classroom management skills through a trauma-informed, restorative approach. It is an ongoing membership, designed for teachers who want to learn, implement and get support over time.
The Membership is facilitated by Claire English, founder of The Unteachables and The Behaviour Club.
The Membership is best suited to teachers of upper primary and secondary students whose values align with an approach to classroom management that is restorative, compassionate and holistic.
What's included
The Membership currently includes:
- The 5-Day Kickstart: a short series of on-demand sessions to help new members start strong and know where to focus first.
- The Training Hub: a library of pre-recorded trainings on classroom management, behaviour and related teaching practice, with a new training added each month.
- The Resource Library: a growing bank of downloadable resources to help you put the trainings into practice.
- The Behaviour Club community: a private online community for members.
- App access: the Membership can also be accessed through the Kajabi app.
The Membership is self-paced. There are no live sessions included in the Membership. We may change, add to or remove parts of the Membership over time, as set out under Fees and payment.
Trainings. Trainings are led by Claire English or by a guest expert chosen for a relevant topic. They are pre-recorded and available inside The Behaviour Club. Topics cover classroom management, behaviour, teaching practice and other topics relevant to supporting teachers in supporting their students. The guidance shared is based on Claire English's experience and qualifications as a secondary educator with experience in school leadership.
Resources. Resources are released alongside the trainings and may include lesson materials, SEL lessons, regulation resources, templates, discussion prompts and more. The number of resources released each month varies. For best results, use the resources to put the trainings into practice. All trainings and resources are provided in English; translations are not available.
Community. The community is a space for members to share, ask questions and support each other. Claire English may post and respond in the community from time to time, but we can't guarantee that every post will receive a response, or a response within a set time.
Behaviour
We ask that you are polite and respectful towards others at all times. If your behaviour is offensive or inappropriate, we may remove you from the Membership with immediate effect.
Each member is responsible for their own behaviour. We are not responsible for the behaviour or actions of other members.
Fees and payment
The price of your Membership is set at the time you join. Payments are taken via Stripe or PayPal.
Monthly memberships renew automatically and are charged on the same day each month until you cancel.
Annual memberships renew automatically and are charged on the same day each year until you cancel.
Your price is locked in for as long as your Membership stays active. If you cancel and later rejoin, you'll join at the price and on the terms offered at that time.
We may change the content and delivery of the Membership, and the price for new members, at any time. We will not increase the fee for your existing Membership without giving you at least 28 days' notice in advance, so you can decide whether to continue.
Refunds and cancellation
We want you to be completely happy with The Behaviour Club. We also understand there may come a time when you want to leave.
Because you get instant access to the trainings and resources, fees are non-refundable, including if you change your mind. Please read the details of the Membership carefully before you join, and get in touch if you have questions about whether it's right for you. Nothing in these Terms affects your rights under the Australian Consumer Law or any other consumer law that applies to you.
You can cancel anytime. Your Membership will end at the end of your current billing period (month or year), and you'll keep access until then. If you leave, we'll miss you and hope to stay in touch!
We may close the Membership for any reason. If we do, we will refund the unused part of your current billing period.
Without limiting any other right or remedy available to us, we may cancel your Membership with immediate effect if:
- you fail to pay your Membership fees by the due date;
- you seriously breach these Terms; or
- your conduct breaches the Behaviour section above.
Contact
We intend the Membership to run continuously. If an unforeseen issue affects a training or resource release, we'll provide it as soon as reasonably possible.
You can contact us by email at [email protected]. Please allow 48 hours for a response, excluding weekends and public holidays. We operate in the Sydney time zone (AEST/AEDT).
You may see us post on social media outside our core hours. Not all posts are live, as some are scheduled. Where we can, we may respond outside our hours, but we can't guarantee this.
Disclaimers
We make no guarantees about the results of any member. Every teacher and classroom is different. Our aim is for teachers to make consistent, genuine progress in their classroom management, but this depends on how you engage with and apply the material.
All trainings and resources are general information and guidance, not advice tailored to your situation. We are not responsible for any action or inaction you take as a result of information in the Membership.
We ask all members to respect the rights and privacy of others. We are not responsible for the actions of any member, including any disclosure by a member of information shared within the Membership.
Limitation of liability and indemnity
To the fullest extent permitted by law, we limit our liability for any harm resulting from your use of all or any part of the Membership. We are not liable to you for any damages, including lost profits, whether the claim is based on warranty, contract, tort or otherwise, even if we were told such damages were possible.
If we are found liable to you for any loss or damage connected with your use of the Membership, our liability will not exceed the total fees you paid us for the Membership in the 6 months before the claim arose.
Nothing in these Terms limits or excludes our liability for fraudulent misrepresentation, for death or personal injury caused by our negligence, or for any other liability that cannot be limited or excluded by law.
You agree to indemnify and hold us, our subcontractors and employees harmless from any claim or demand, including legal fees, made by a third party arising from your breach of these Terms or your violation of any law or the rights of a third party.
Privacy and confidentiality
Your privacy is important to us. You are responsible for keeping your contact details accurate and up to date.
Your personal data is protected as set out in our privacy policy at www.the-unteachables.com/privacypolicy. By providing your personal data, you agree to that policy.
In the community you may see personal information about other members. You agree not to use or disclose any confidential information about another member to anyone, and to use your best efforts to prevent its publication. Any unauthorised disclosure of another member's personal or confidential information may lead to immediate removal from the Membership. These obligations continue after you leave.
Please think carefully about what you share in the community. Anything you post can be seen by other members. Please don't share identifying information about your students.
Your login details must stay confidential and must not be shared with anyone else without our written permission. Memberships are for individual use. If you know or suspect that someone else has your login details, please change your password straight away and let us know at [email protected].
Intellectual property
All trainings, resources and other materials in the Membership remain our intellectual property, and we retain all copyright. You may use the materials for your own professional learning and with your own classes, for example presenting a lesson or using a resource with your students. You may not copy, republish, reproduce, distribute, sell, translate or share the materials with anyone else, including colleagues, or present them as your own.
Non-solicitation
While you are a member, and for 12 months after your Membership ends, you agree not to use confidential information from the Membership for any commercial purpose, and not to solicit or entice away other members by private message, follow requests or other targeting.
Waiver
If we don't insist on you strictly performing any of your obligations under these Terms, or don't exercise any of our rights or remedies, that doesn't mean we have waived them.
Errors and inaccuracies
Our website or the Membership may occasionally contain typographical errors, inaccuracies or omissions about the services, pricing or promotion of the Membership. We may correct these without notice.
Governing law
These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have exclusive jurisdiction over any matter arising from the Membership.
Complaints
We want you to be completely satisfied with the Membership, and we welcome feedback. If you have a complaint, please email Claire English at [email protected].
General
These Terms are the entire agreement between us for the Membership.
If there is any conflict between these Terms and the terms of a hosting platform or payment provider, these Terms prevail.
If any provision of these Terms is found to be unlawful or unenforceable, the rest of the Terms continue in effect. If removing part of a provision would make it lawful or enforceable, that part is treated as removed and the rest continues, unless that would contradict the clear intention of the Terms, in which case the whole provision is treated as removed.
No provision of these Terms is enforceable by any third party.
Frequently asked questions
Are there live sessions? No. The Membership is self-paced. All trainings are pre-recorded, so you can watch them whenever suits you.
What if I need additional support? You can ask questions in the community. Additional 1:1 support may be available for an extra fee; please contact us directly.
